Terms of Service

Effective date: [SET AT LAUNCH]. These terms are an agreement between you and [LEGAL ENTITY NAME] ("we"), reachable at support@whybabywhy.app. By using the Why Baby Why app or website you accept them.

The service

Why Baby Why helps caregivers keep a timeline of routine events and cry descriptions. When you record a crying episode, the service returns a neutral written description of what is audible. The app does not infer causes, assign probabilities, score severity, screen, or triage.

Not medical advice

Nothing in the service is medical advice, and no output is a statement about your child's health. Interpret the information in a timeline with your pediatrician or another qualified professional. If you are ever concerned about your baby's wellbeing, contact a medical professional or your local emergency service — never wait on this app.

Who may use it

You must be an adult caregiver — a parent or someone responsible for the child's care — to use the service. By recording a child, you confirm you are authorized to make decisions about that child's information, including consenting to the processing described in the Privacy Policy.

Your content

You are responsible for the information you choose to record and share. You keep all rights to your recordings and notes; you give us only the permission needed to operate the service — to store, process, and return descriptions of what you record, as described in the Privacy Policy. We may remove content or suspend accounts that abuse the service or attempt to disrupt it.

Subscriptions

A free account includes a monthly allowance of cry descriptions. Why Baby Why Plus is an auto-renewing subscription (monthly or yearly) purchased through Apple that raises that monthly allowance. Prices and terms are shown before purchase. Subscriptions renew automatically until cancelled in your Apple ID settings at least 24 hours before the end of the current period. Refunds are handled by Apple under Apple's terms; when Apple notifies us of a refund, the subscription allowance ends.

Ending the agreement

You can stop using the service at any time and delete your account from Settings, which permanently removes your server data. Deleting the account does not cancel an Apple subscription — cancel it in your Apple ID settings. We may suspend or end access for abuse, unlawful use, or attempts to compromise the service or other users' data.

Service limits and liability

The service is provided as-is. We do not promise it will be uninterrupted or error-free, and descriptions of a recording may be incomplete. To the fullest extent the law allows, we are not liable for indirect or consequential damages, and our total liability is limited to the amount you paid for the service in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.

Changes and governing law

If these terms change materially, we will publish the updated terms on this page with a new effective date before they take effect; continued use after that is acceptance. These terms are governed by the laws of [JURISDICTION], without regard to conflict-of-law rules.
